Terms of Service

1. Who we are & acceptance

FundedPoly (“FundedPoly”, “we”, “us”) is a skill-evaluation and simulated-funding product operated by [Legal Entity Name], [Registered Address]. By creating an account, purchasing a challenge, or using the site, you agree to these Terms, our Privacy Policy, Refund Policy, and KYC & AML Policy. If you don’t agree, don’t use FundedPoly.

2. Eligibility

You must be at least 18 years old and legally able to enter into this agreement. FundedPoly is not available in jurisdictions where prediction-market trading is restricted (including the United States) or in sanctioned territories. You are responsible for ensuring your use is lawful where you live. We may verify your identity and location and refuse or close service accordingly.

3. What FundedPoly is

FundedPoly is an evaluation product. You purchase a challenge and trade a simulatedaccount that mirrors live Polymarket prices, order books, and fills in real time. If you meet the published targets within the rules, you receive a simulated “funded” account; profits realized on it are paid to you in crypto under the profit split below.

FundedPoly is not a broker, exchange, bank, or investment adviser. Nothing on the site is financial, investment, or trading advice. We do not hold customer funds for trading or place real positions on Polymarket or any venue on your behalf.

4. Purchases & fees

A challenge requires a one-time entry fee shown at checkout. The fee is the most you can lose — there is no further liability, collateral, or clawback. Your account opens as soon as payment is confirmed.

All sales are final once you begin trading. Purchases are refundable only while no trade has been placed on the account — see our Refund Policy for the full terms.

5. Simulated trading & no affiliation with Polymarket

All accounts — challenge and funded — are simulated. We mirror Polymarket market data; we are an independent product and are not owned by, operated by, endorsed by, or affiliated with Polymarket. “Polymarket” is referenced only as the source of the prices we mirror. Market data may be delayed or unavailable; during an outage we may pause orders and risk checks.

6. Evaluation rules & breaches

Each challenge has published rules — profit target, drawdown limit, maximum exposure per trade, minimum trading days, and (where applicable) a consistency requirement. The rules in effect for your account govern it. Breaching a hard rule (for example, exceeding the drawdown limit) closes the account; this is final. We may update rules for future purchases and will keep the rules that applied when you bought a given account.

7. Payouts & profit split

On funded accounts you keep the published share of realized profit (the remainder is ours). Payouts are a one-time cash-out that closes the account, are subject to the eligibility and consistency rules, and are paid in USDC or USDT to a wallet and network you choose.

Every payout requires identity verification (KYC) and a compliance review before any funds are sent — see Section 8 and our KYC & AML Policy. Crypto transfers are irreversible; you are responsible for the accuracy of the destination address and network.

8. Identity verification (KYC) & AML

Before your first payout you must complete identity verification: we collect your legal name, date of birth, contact details, residential address, and government-issued identity documents, and we screen against applicable sanctions lists. We will not release a payout — including an automatic Jackpot payout — until your identity is verified and the review clears. We may request additional information, and we may withhold, delay, or refuse a payout and suspend or close an account where verification fails or where we are required or permitted to do so by law. 9. Acceptable use

Don’t create multiple accounts to circumvent rules or limits; don’t use another person’s identity, payment method, or documents; don’t exploit bugs, latency, or pricing errors; don’t use bots or automation to abuse the platform; and don’t engage in fraud, money laundering, or market manipulation. We may void results, withhold payouts, and close accounts that breach this section.

10. Suspension & termination

We may suspend or terminate access at any time for breach of these Terms, suspected fraud or abuse, legal or compliance reasons, or risk to the platform. Where an account is terminated for cause, related results and payouts may be forfeited. Audit records of trades and settlements are retained as described in the Privacy Policy.

11. Disclaimers & limitation of liability

The service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted access, accurate or timely market data, or any outcome. To the maximum extent permitted by law, FundedPoly is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the fees you paid us for the account giving rise to the claim.

12. Changes

We may update these Terms. The “last updated” date above changes when we do, and continued use after an update means you accept the revised version.

13. Governing law & disputes

These Terms are governed by the laws of [Governing-law Jurisdiction], and the courts of that jurisdiction have exclusive jurisdiction over any dispute, except where mandatory local consumer law provides otherwise.
